Halle Berry‘s attorney rejected abuse allegations from ex-husband Olivier Martinez after Martinez obtained a temporary restraining order Thursday. Attorney Marina Beck called the filing “entirely meritless and deliberately misleading” in a statement to Fox News Digital.

Martinez is seeking sole custody of their 12-year-old son, according to the Fox News report. The allegations and Berry’s attorney’s response remain competing accounts, rather than findings resolving the underlying dispute.

Halle Berry Attorney Rejects Martinez’s Allegations

Documents obtained by People magazine and TMZ describe Martinez’s allegations of physical and emotional abuse. Martinez identifies a September 26, 2026, incident and claims other incidents occurred over the last few years.

Martinez alleges the incident caused emotional and mental distress. Fox News also reported that Martinez accused Berry of verbal and emotional abuse toward Martinez.

Beck disputed the account in a statement to Fox News Digital. The attorney alleged Martinez had repeatedly violated court orders and interfered with necessary therapeutic and educational interventions.

“There is voluminous evidence, including numerous judicial rulings, that Olivier Martinez repeatedly violated court orders and interfered with necessary therapeutic and educational interventions to the detriment of his and Halle Berry’s minor son Maceo.”

Beck said Martinez had already been legally sanctioned for that alleged misconduct. Those characterizations come from Berry’s attorney and remain attributed to that statement.

The attorney said Berry was deeply saddened but would continue fighting for the child’s best interests. Representatives for Martinez did not immediately respond to Fox News Digital’s request for comment.

Temporary Order Limits Contact Before Hearing

TMZ reported that Halle Berry must remain 100 yards from Martinez under the temporary order. The report described restrictions on visits with their son until an Oct. 16 hearing.

Berry can see the child during court-ordered visits two days a week and every other weekend, TMZ reported. The former couple were also ordered to attend confidential custody mediation.

Martinez’s petition additionally calls for sobriety testing before, during and after visits. That request is part of Martinez’s filing; Fox News did not establish it as a granted requirement.

Halle Berry And Martinez Finalized Divorce In 2023

Halle Berry and Martinez finalized their divorce in 2023, eight years after separating. They first filed for divorce in 2015 after two years of marriage.

Court documents obtained by Fox News Digital show Berry agreed to nearly $8,000 in monthly child support. Berry also pays Martinez 4.3% on income exceeding $2 million.

Berry is responsible for private school tuition, 100% of extracurricular activities and health care. The judgment requires Martinez to take “reasonable action” to find employment and contribute for their son.

The existing agreement divides the child’s weekdays between both parents and alternates weekends, with holiday exceptions. It permits one bedtime phone or video call with the other parent lasting less than 15 minutes.

The agreement also requires both parents to refrain from speaking badly about one another in front of their son. Fox News reported that Berry previously sought sole custody over alleged interference with educational and therapeutic interventions.

The temporary visitation restrictions now apply ahead of the Oct. 16 hearing. The former couple’s confidential mediation will address custody, according to the reported order.
