Lawyers for convicted “Rust” armorer Hannah Gutierrez-Reed are urging New Mexico to release her from prison following the dismissal of Alec Baldwin’s case.

Attorney Jason Bowles filed a motion on Tuesday for a new trial or dismissal, citing “severe and ongoing discovery violations by the State,” as detailed in court documents obtained by NBC News. The filing labeled the discovery violations found during Baldwin’s trial as “egregious.”

The motion follows Baldwin’s criminal trial dismissal on Friday, where 1st Judicial District Judge Mary Marlowe Sommer ruled that special prosecutor Kari T. Morrissey had suppressed evidence related to live ammunition in the 2021 on-set shooting that killed cinematographer Halyna Hutchins.

“There is no way for the court to right this wrong,” said Judge Sommer. “The sanction of dismissal is the only warranted remedy.”

The dismissal, with prejudice, prevents the involuntary manslaughter case against Baldwin from being refiled. Baldwin’s lawyers argued that the Santa Fe County Sheriff’s Office held live ammunition as evidence without recording it or informing Baldwin’s defense team.

Morrissey claimed the disputed ammunition was unrelated to the case and not hidden from Baldwin’s lawyers. “I believe the importance of the evidence was misconstrued by the defense attorneys,” Morrissey told reporters.

In a separate March trial, Reed was convicted of involuntary manslaughter and sentenced to 18 months in prison. Bowles also called for Morrissey’s removal as Special Prosecutor for her misconduct and violations in Reed’s case.

Last week, Bowles said, “The judge absolutely made the right decision on the law and on the facts. … The judge found the state committed misconduct. A lot of emotions. I mean, seeing Mr. Baldwin, knowing what he was going through, knowing what Hannah Gutierrez-Reed is going through right now being in prison, and that the state has committed a pattern of violations of discovery … it’s devastating.”
